Identification of the data controller
This Cookie Policy explains which cookies the website ingenial.com.co uses, what they are for and how users can accept, reject or withdraw their consent. It supplements and forms part of INGENIAL's Personal Data Processing Policy. Anything not provided for here is governed by that Policy, including the definitions, the rights of the Data Subject and the procedure for inquiries and claims.
Legal framework
Colombia has no specific law on cookies. When cookies make it possible to collect information linked or linkable to an identified or identifiable natural person, that information is personal data and its Processing is governed by:
- Article 15 of the Political Constitution of Colombia (right to habeas data).
- Statutory Law 1581 of 2012, especially its principles of purpose, freedom and transparency (Article 4) and the requirement of prior, express and informed authorization (Article 9).
- Decree 1074 of 2015, Book 2, Part 2, Title 2, Chapter 25.
- The instructions of the Superintendence of Industry and Commerce, Colombia's national personal data protection authority.
For this reason, INGENIAL only activates cookies that are not necessary for the operation of the site after the user has accepted them.
What cookies are
Cookies are small text files that a website saves in the user's browser when they visit it. They allow the site to remember information about the visit, such as the preferences chosen or the pages viewed. This Policy also applies to similar technologies, such as the browser's local storage and measurement tags (scripts).
Depending on who sets them, they can be:
- First-party: set by the domain ingenial.com.co.
- Third-party: set or managed by a different domain, such as Google.
Depending on how long they last, they can be:
- Session cookies: deleted when the browser is closed.
- Persistent cookies: they stay in the browser for the period shown in the table in section 4, or until the user deletes them.
Cookies used by the site
The site uses two categories of cookies: necessary cookies, which are always active, and analytics cookies, which are only activated if the user accepts them. INGENIAL does not use advertising, remarketing or profiling cookies.
The durations of _ga and _ga_11J37Q4B92 are the defaults reported by Google (source).
Necessary cookies. They are essential for the site to work and to respect the user's choice about cookies. They do not identify the user and are not used for any other purpose.
Analytics cookies. They allow INGENIAL to learn, in aggregate form, how many people visit the site, which pages they view, from what type of device and for how long. INGENIAL uses this information only to measure the use of the site and to improve its content and operation, a purpose provided for in section 6 of its Personal Data Processing Policy. It does not use it to personally identify the visitor or to send them advertising.
Consent and how to manage cookies
Prior consent. When the user first visits the site, they see a notice that lets them accept or reject analytics cookies. The Google Analytics code is not loaded and no analytics cookie is set until the user accepts them. Continuing to browse, closing the notice or not responding is not taken as acceptance.
Rejection. Rejecting analytics cookies does not prevent access to the content or use of the site's features.
Changing or withdrawing consent. The user can change their choice at any time using the "Cookie settings" button in the site footer. If they reject the cookies after having accepted them, the site disables measurement and deletes the _ga cookies from their browser. Withdrawing consent stops measurement from that moment, but does not affect Processing carried out before.
From the browser. The user can also block or delete cookies from their browser settings:
In addition, Google offers a browser add-on to opt out that prevents Google Analytics from measuring your visit on any site.
Proof of consent. INGENIAL keeps a record of the user's choice in their browser through the necessary record described in section 4.
Google Analytics, international transmission and retention
Google as Processor. Google Analytics 4 is a service of Google LLC, which processes measurement information on behalf of INGENIAL on servers that may be located outside Colombia, including the United States. This communication of data is an international transmission to a Processor, governed by Google's terms of service and data processing terms and by section 11 of INGENIAL's Personal Data Processing Policy, in accordance with Articles 2.2.2.25.5.1 and 2.2.2.25.5.2 of Decree 1074 of 2015. The user can learn how Google handles information in its Privacy Policy.
Retention. Cookies remain in the browser for the periods shown in the table in section 4, unless the user deletes them earlier. In Google Analytics, event data is kept for 2 months and user-level data for 14 months; this last period restarts each time the user visits the site again. Once these periods have passed, the data is deleted automatically; aggregated reports that do not identify any person may be kept for longer.
Third-party links. The site contains links to third-party sites, such as LinkedIn, Instagram, Facebook and Google Forms. When visiting them, those sites may set their own cookies under their own policies, which INGENIAL does not control. Users are advised to review them.
Data Subject rights, changes and effective date
Rights. As a Data Subject, the user can access, update and correct their data, request its deletion and revoke the authorization given, by writing to info@ingenial.com.co. These requests are handled according to the procedure and timeframes in section 10 of the Personal Data Processing Policy. To stop being measured, it is enough to reject analytics cookies or delete them from the browser.
Changes. INGENIAL will update this Policy when it adds, changes or removes cookies or tools on the site. If a change involves a new purpose or a new category of cookies that requires consent, the cookie notice will ask for the user's choice again before activating them.
Effective date. This Policy is effective from October 21, 2026.
